Pues por lo que yo entiendo del párrafo que has pegado, que se puede
distribuir la máquina siempre que sea con el propósito de ejecutar el
software que toque (en este caso gvSIG).

Yo no diría que por NO usar el instalador ya se está modificando el
software. Y tampoco se está modificando nada de la máquina virtual,
así que tal como yo lo veo es correcto incluir la JRE en el instalador
de tu software, y como bien dices, esto lo hacen infinidad de
productos tanto libres como privativos.
